These Terms & Conditions govern services provided by Prosperian LLC, doing business as GreenGrowth Seeding SnowCo. This is a plain-language draft and should be reviewed with your attorney before final publication.
Services
We provide hydroseeding (erosion control, full lawn establishment, and patching) and snow & ice removal services for residential and commercial properties in our service area. A specific scope of work will be provided in your quote.
Quotes & scheduling
Quotes are valid for 30 days unless otherwise stated. Scheduling is subject to weather conditions, ground conditions, and route availability. Hydroseeding jobs are booked around favorable weather windows; snow removal is dispatched based on storm timing and contract triggers.
Site conditions & access
Customer is responsible for identifying property lines, sprinkler heads, invisible fencing, landscape lighting, and other buried or low-clearance items before service. We are not liable for damage to unmarked items or items outside the agreed scope of work.
Payment
Invoices are due within 15 days of receipt unless otherwise agreed in writing. Past-due balances may accrue a reasonable late fee. Seasonal snow contracts may require a deposit or pre-season payment.
Weather & results
Hydroseeding results depend on watering, weather, and site conditions. Customer is responsible for following the watering schedule we provide. Snow removal timing during active storms depends on storm intensity, route timing, and equipment availability; we aim to service each account on a reasonable schedule but cannot guarantee an exact time.
Emergency service
We offer emergency snow removal during winter storms when capacity allows. Emergency service may be subject to additional charges.
Limitation of liability
Our total liability for any claim relating to services is limited to the amount paid by the customer for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
Governing law
These terms are governed by the laws of the State of Minnesota. Any disputes will be resolved in a court of competent jurisdiction in Minnesota.
